    Capital Improvement Advisory Committee

    Purpose

    The county’s Impact Fee program was established Jan. 1, 1996. The Bernalillo County Impact Fee Ordinance, Chapter 46 of the County Code as amended and the State of New Mexico Development Fees Act (NMSA 1978, § 5-8-1 et seq.) require the development of an Impact Fees Capital Improvements Plan (IFCIP) and creation of an Advisory Committee to identify the types of capital improvements or facility expansions for which impact fees may be assessed. Both the ordinance and the statute call for updating the IFCIP at least every five years.

    Composition

    A Capital Improvement Advisory Committee (Advisory Committee) is hereby established, in conformance with the New Mexico Development Fees Act. The Advisory Committee shall be composed of five voting members appointed by the Board of County Commissioners or their designated representative. No member of the Advisory Committee shall be an employee or official of a municipality or county or other governmental entity. Not less than 40 percent of the voting membership of the Advisory committee shall be representatives of the real estate, development or building industries. That after the requirement of section four above has been met, the remaining Advisory Committee membership shall be drawn from (a) Community Representatives (such as neighborhood organizations), and (b) professionals dealing with land use matters (such as professional engineers, architects, or land use planners).The term of each member shall be three years unless the appointment is to fill a vacancy. The initial terms of the members of this board shall be staggered so that at least one member from each of the above mentioned groups is eligible for reappointment or replacement each year.
