A new state law means Bernalillo County land owners must now pay their current property taxes before subdividing or combining their properties for development.
Previously, they could pay their taxes with everyone else at the end of the tax year.
The new law, NM State Statute 7-38-44.1, took effect in the spring of 2013.
The new law reads: “A taxpayer shall pay the taxes, penalties, interest and fees due on real property divided or combined through the taxable year in which the property is divided or combined prior to filing a plat.”
What it basically does is ensures that land owners pay their taxes if they want to develop their land.
Previously, if land owners defaulted on paying their taxes, for two or more years on subdivisions, they would be turned over to the New Mexico Property Tax Division for collections.

About 135 plat split/combination requests are processed by the County Assessor’s Office each year.
