The Bernalillo County Board of Commissioners initiated a temporary reduction of Impact Fees effective July 1 to December 31, 2009. The reductions are available to construction projects with building permit applications submitted between those dates. 

The new fee schedule includes:

  • A 50% reduction in impact fees for standard residential construction.
  • A 75% reduction in impact fees for sustainable residential construction certified by Build Green NM or LEED (as outlined in the criteria below).
  • A 75% reduction in impact fees for nonresidential construction, other than that qualifying for a full impact fee waiver as an economic base development project.

In order to qualify for the additional credit available for sustainable residential construction, the owner or builder must provide certification that the construction meets the requirements established by the State of New Mexico for sustainable tax credits. This includes:

  1. A  HERS (home energy rating system) rating of 60 or Lower (a HERS 60 means a residence that is 40% more efficient that a “code” built home baseline in 2004); and
  2. The level of “Silver” or higher in either Build Green NM or LEED H (Leadership in Energy and Environmental Design for Homes);

These programs provide third party certification for:

  • Energy Efficiency
  • Water Efficiency
  • Resource Efficiency
  • Indoor Air Quality
  • Lot Design for proper climate zone
  • Homeowner Education (for a sustainable residential building)

Impact fees are calculated at the time of building permit application. Fees are paid at the time the building permit is issued. All residential permits will be calculated at the standard reduced rate (50% of the normal fee), between July 1 and December 31, 2009. Since sustainable building certification is provided after a building is completed, the owner or builder must provide the county with a certification packet, including the rating system certification level awarded to the building, prior to the issuance of a Certificate of Occupancy for the structure. After verification of the certification the county will issue a refund of 50% of the Impact Fee paid, reducing the total fee to 25% of the normal amount. Certification packets may be submitted anytime prior to the issuance of a Certificate of Occupancy, provided that the building permit remains active.

Build Green New Mexico rating system -  the certification standards adopted by the Home Builders Association of Central New Mexico.

LEED - the most current Leadership in Energy and Environmental Design green building rating system guidelines developed and adopted by the US Green Building Council.

LEED-H - the LEED rating system for homes.

LEED silver - the rating in compliance with, or exceeding, the third-highest rating awarded by the LEED certification process.

LEED gold - the rating in compliance with, or exceeding, the second-highest rating awarded by the LEED certification process.

LEED platinum - the rating in compliance with, or exceeding, the highest rating awarded by the LEED certification process.

Sustainable Residential Building -

  • A building used as a single-family residence or multi-family dwelling as registered and certified under the Build Green New Mexico or LEED-H rating system that:
    • Is certified by the United States green building council as LEED-H silver or higher or by Build Green New Mexico as silver or higher; and
    • Has achieved a home energy rating system index of sixty or lower as developed by the residential energy services network;
